Well one applies to all domestic sales, so doesn't discriminate on the basis of national origin of the producer. The other is a charge on cross-border sales so only applies to out-of-jurisdiction producers.

Well from a Scottish perspective, duty does not create an unfair playing field, because it is imposed equally on Scottish malts as it is on US or Japanese ones. Tariffs make Scottish malts uncompetitive in the US (a principal market) against US or Japanese whiskeys as the tariffs

Market share means it definitely does hurt producers. UK is a huge market for Scotch.
