Well from a Scottish perspective, duty does not create an unfair playing field, because it is imposed equally on Scottish malts as it is on US or Japanese ones. Tariffs make Scottish malts uncompetitive in the US (a principal market) against US or Japanese whiskeys as the tariffs

are only applied to Scottish malts so make them comparatively more expensive. Producers may want to argue against duty as well, that would lower the price too, and they can do so, but it is not selectively unfair to them as it applies to all producers.
