I’m pretty sure I could say “rule of law” before the case was argued before the High Court, Court of Appeal and then Supreme Court. That’s why the nobile officium case is so important: the timetable is much tighter than people appreciate

I assume he has the Civil Contingencies Act in mind, which allows legislation to be suspended in an ‘emergency’. But the latter is a defined term which wouldn’t be satisfied in current conditions - and the Act specifically allows for judicial review of emergency regulations.
