The Republicans have the constitutional right to do what they want so long as it is constitutional. McConnell, Graham and GOP leaders lying through their teeth about the Garland Rule is wrong but not unconstitutional. Neither is following Lincoln’s example of expanding the Court.

From Bork to Estrada to Reid to Garland to McConnell trashing the filibuster, there are no political norms or guardrails regarding the Senate’s Supreme Court process. McConnell’s radical “Might Makes Right” approach has opened the door to any constitutional act.

Re: the court packing issue, shouldn't the answer be "if the R's force a Coney Barrett nomination before the election, all our cards are on the table"? Drop it, then court packing is off the table. Force the issue onto the R's shoulders?
