Barrett claims judges are to apply the law as written. If that were true, we would need no judges. The Constitution is not a set of math formulas that have their essence in form. The provisions of the Constitution are organic living institutions transplanted from English soil.

Most questions of law come down to claims of competing rights that judges are called upon to balance with sensitivity, analysis & an appreciation for their consequences to society. Judges judge. That’s why their personal philosophies determine policy even if they don’t admit it.
