Nothing wrong with Justice Gorsuch having dinner with Republican Senators. Outrage on this reflects desire to turn all substantive disagreement on issues into "ethics" controversies. Better to focus on Gorsuch's votes and opinions -- which offer many grounds for argument.

Consider the context- Gorsuch has also basically been campaigning for Mitch McConnell. Maybe normally a dinner would be no big deal, but when a new sitting justice has already shown a willingness to wade into politics, such a dinner is suspect.

Also, @JeffreyToobin, I nearly always agree but this is off base. Your second sentence is just unsubstantiated punditry that I expect from many of your colleagues but not you. Do you have evidence that such a desire actually exists?

The third point just misses the mark entirely. Disagreements with Justices is a fine academic exercise, but not the serious issue. Gorsuch was appointed to the Court by a corrupt process and a corrupt president and is acting corruptly. That's important.

He can have dinner with 7 billion other people. How can we possibly sit here and say there is nothing wrong with the judicial branch dining with the legislative when the thing that will come up, with 100% certainty, are policy issues Republican Senators want advanced! #sepofpwrs

This is what's wrong with the US press...There is something seriously wrong with a member of the Supreme Court having an issues based strategy session with Senators on one side of the aisle...

Disagree. Esp. now, SCOTUS should do all it can to appear non-partisan. Vital to public's confidence. Yet Gorsuch gives speech at Trump hotel, arguably campaigns w/ McConnell, dinner w/ GOP Senators. Why?

I respectfully disagree. I know you're the expert but public perception of the impartiality of the justice system is as important as the actual ethics rules. Gorsuch got the nomination through skullduggery on McConnell's part & hanging out w/those who facilitated that is wrong.

The Trump administration (and Republicans in general) are normalizing conflicts of interest. It's all kinds of wrong for Gorsuch to be discussing policy with Repub Senators.

Disagree strongly. Judges of the Supreme Court should not be at "private" dinners with politicians of any stripe. And they also shouldn't be at political fundraising type events. Debases the court

I haven’t seen outrage. I’ve seen people asking whether it’s appropriate for a justice to have a dinner discussing “issues” with politicians — whose laws will likely come under scrutiny of the court.

Gorsesuch should be tossed out. Only remedy. GOP violated constitution in thinking Madison was an idiot to leave a loophole. "advice AND consent" and they did neither. They disenfranchised the vote of Millions and had the arrogance to claim they were working for their constituents

Mr. Toobin, legally you’re probably right. But, like Caesar’s wife, Justice Gorsuch must be above suspicion. And that includes optics in times of extreme political turbulence.
