Have emailed with Sargon. This is for real. He had no strikes on the channel and now can’t even log in. What’s the deal, @TeamYouTube? https://twitter.com/nickmon1112/status/969207786268708864 …

The public sphere is not private property.

As of today (in the US), YouTube and twitter are not considered the public square. Unfortunately the Gov has not caught up with tech and still hasn’t passed the laws to declare this. I am hopeful it will happen, but may take awhile.

The "public sphere" exists prior to law; it's what law tries to catch up to. It's nature is why laws like the 1st amendment are passed. But yeah, the law hasn't caught up and it behooves us to say so.

Correct me if I'm wrong, but aren't Youtube and the like privately owned? I believe that means it'd be more akin to going into a restaurant and saying whatever you want, rather than the public square, which I believe only applies to Government/public funded places.

It depends... in three states they ruled that private malls are public squares (one state decided that the mall of America can stop protests that may hurt sales or cause issues with other shoppers, but that was the extent of the ruling)

I suppose then we'd have to ask if any of these states are where Youtube's headquarters are located, and/or delve into if there are any other exceptions like this on the books if they're located elsewhere.

One of the states that recognized large shopping malls as public space is CA ( https://www.aclunc.org/our-work/know-your-rights/free-speech-protests-demonstrations … ), where Google is headquartered

An interesting precedent is river law. Rivers flow through a variety of properties, but belong to none of them. They're a sort of commons. Similarly, and especially online, political speech could be viewed as a sort of commons that flows through private infrastructure.
