I would imagine that this would be among the materials the special master reviewed/is reviewing to determine whether it is privileged. For it to be privileged Cohen would have to be acting in his capacity as Trump’s attorney on a legal matter 1/

And the conversation would have to be only between Cohen and Trump (if a non-client third party is party to the conversation, no privilege). And if the convo itself is about facilitating or covering up a crime, the crime-fraud exception would pierce an otherwise privileged convo

You don't have attorney client privilege if you're asking an attorney to do stuff outside the realm of what an attorney does. For example, if you hire an attorney to clean your car, there is no privilege. Additionally, as you know, you can't contract for anything illegal.
