Actually, 1941. Germany screwed up by declaring war on us Dec. 11th. They did that because Hitler acted without really thinking and issued the Declaration himself. THAT changed everything.

Couldn't we consider the overarching "War on Terror" to be a declaration of war, via Authorization for Use of Military Force (S.J.Res.23)? It was for sure not an instance of direct war declaration, but was not just actions taken without approval by the President. (i.e. Syria.)

I see. Interesting point. I didn't know it was an AUMF....but we have had AUMF's since 1950's Taiwan. How did they change the rules on Iraq?
