2/2: In this case, the intent was very clear. Citizenship is not automatically given if a person is born in the US, their parents or parent must be a natural born citizen or naturalized through the immigration process.

I'm not sure what the naturalization process was like int he 1860s, but I'd argue that being a legal Permanent Resident counts, also.

Yeah, problem with that reasoning is, if you are from Ireland on vacation in New York, are you not subject to “the jurisdiction” of that State ie it’s Laws concerning almost everything. Pretty tough to argue no.
