    Since George Floyd's murder, we've been looking closely at deaths in police custody. And we noticed something — the same names, popping up over and over. Doctors and scientists, whose research & testimony has repeatedly been used to exonerate officers. 1/

    We can’t lose sight that Kim Potter was part of broader systems failures that include policy, training, and equipment design. A seemingly small decision not to move Mr. Wright away from the open driver’s door (tactics). Stops for minor violations (policy). The “innocuous” matters

    Kimberly Potter, the former police officer who fatally shot Daunte Wright after seeming to mistake her gun for her Taser, was convicted of two counts of manslaughter on Thursday. A judge will sentence Potter at a hearing scheduled for February.

    ...remember that this isn't complete victory-it means only that the case can go to trial. And juries tend to be unfriendly to plaintiffs in civil rights cases. (My research found civil rights plaintiffs win at trial about 15% of the time.) And remember also...

    This is an enormous victory for the Timpas, who lost their son, and for the attorneys working on the case, including Geoff Henley and Susan Hutchison, and Easha Anand and . It is a tremendously important case for civil rights lawyers in the 5th circuit. But...

    The Fifth Circuit's decision in Timpa v. Dillard also clarifies that the law can be clearly established in 4th A cases even if there is not a prior court decision where the exact type of force was used under the same circumstances.

    A reminder that the Dallas Morning News and NBC5 had to fight for three years and get a court order to obtain footage of Timpa's death.

    Just now heard from Tony Timpa's attorneys that 5th Circuit Court of Appeals has reversed & remanded the lower fed. court decision that said Dallas Police officers were protected by qualified immunity in his 2016 death...
