    Here’s my latest for ⁦⁩ about Tony Timpa, who was killed beneath the knee of a Dallas police officer in 2016. His family’s case was dismissed on qualified immunity grounds - but they just got good news from the 5th circuit.

    Since George Floyd's murder, we've been looking closely at deaths in police custody. And we noticed something — the same names, popping up over and over. Doctors and scientists, whose research & testimony has repeatedly been used to exonerate officers. 1/

    ...the Timpas and reporters had to fight for almost 3 years to get body cam footage of Timpa's death. Without that video, the case would have been over years ago.

    ...remember that this isn't complete victory-it means only that the case can go to trial. And juries tend to be unfriendly to plaintiffs in civil rights cases. (My research found civil rights plaintiffs win at trial about 15% of the time.) And remember also...

    This is an enormous victory for the Timpas, who lost their son, and for the attorneys working on the case, including Geoff Henley and Susan Hutchison, and Easha Anand and . It is a tremendously important case for civil rights lawyers in the 5th circuit. But...

    The Fifth Circuit's decision in Timpa v. Dillard also clarifies that the law can be clearly established in 4th A cases even if there is not a prior court decision where the exact type of force was used under the same circumstances.
