I think the most important thing is... He will lose. And he should lose. And some folks in the industry should step up and make sure he loses quickly and thoroughly without bankrupting some poor indie guy for selling $150 worth of constitutionally protected parody.

I think we should let the lawyers figure who is right or wrong not us Twitter lawyers. The courts are the only ones that can determine if fair use and parody defense are valid. I would not use someones IP unless it was worth going to court, if it is then do it.
