YouTube regularly and with great gusto punishes people who aren't breaking the terms of service, and doesn't punish people who do (see Logan Paul and Daddy o Five) until the media backlash becomes so unignorable that they do the bare minimum to squeak by with their pants still on

Yep, exactly why they're looking into their harassment policies. People are not impressed, and it's not because it's "meant to be an open platform", it's because YouTube has allowed harassment to occur. Otherwise they'd be undoing any policies with restriction on site content.

Also, terms of service are considered rules, guidelines and disclaimers in some regards, but they are not contracts. Contracts are legally binding documents that, when broken, result in legal action. Terms of service, when broken, result in account punishments or termination.
