Attending the Supreme Court argument yesterday, I thought it interesting how the "government" was kind of on both sides of 's case, and how that seemed to mean the justices were more engaged. So I wrote this short piece. 1/2

"[I]f conservatives contend that trade and immigration are somehow arbitrarily exempt from nondelegation principles that should apply everywhere else, then they can hardly claim that nondelegation is a meaningful, neutral rule of constitutional law."

Thank you for your Live TV service! I just watched the entire Super Bowl on a flight, including when the pilot allowed it to keep playing to the last touchdown as people were exiting. Give the staff on that plane a raise.

Astronauts have personal skin in the game, and there’s no shortage of them. Same for commercial fisherman. And firefighters. And fighter pilots. And deep sea commercial divers. I’m willing to gamble SCOTUS is wrong that prosecutors alone would all quit if they had to do likewise.

Courts have issued universal injunctions for the past century. But only recently have such injunctions become controversial. Just last week, some on both the left and the right called for to ban them. But universal injunctions are here to stay.

Justice Warren adds that how do you determine the original meaning of a constitutional provision in a state constitution that was unchanged from previous versions of the constitution? I had some thoughts about that here . . .
