      Then they should go do that. The IRS allows the LF to be tax exempt because it putatively has a public mission; employees and officers should be drawn to that mission, not for FANG-like compensation

      Conventionally, a (c)(6) is a professional development organization or chamber of commerce. Their use in tech as holding companies for mission-critical code has always seemed a little oddball to me. Perhaps Open Source code SHOULD be part of a (c)(3) and beholden to public good.

      The use of (c)(6) always made a lot of sense to me. Linux is a business: the foundation's objective is substantial, sustainable commercial adoption. A (c)(6) most accurately reflects that since their objectives are not definitely not charitable or educational.

      Everything you say here both makes perfect sense and is also a very concise outline of my concerns. All these decisions have pros and cons, even if Linus weren’t in the picture.

      Sort of! But as far as I’m aware OSI isn’t really a custodian of projects, and that role is what I’d be really interested in seeing. Of course, GNU caught its fair share of controversy for engaging in exactly the kind of activism my thinking might suggest.

      If the Linux Foundation became a 501c3 then it would be more difficult to engage in political action than as a 501c6. They have opponents with not just FUD but political contributions in the pipeline

          501(c)(3) orgs can engage in political action around issues just not candidates. (That's not to say I think LF should be a 3c.)

          That's not really the case. A (c)(3) can't intervene in political campaigns, but it can still apply all kinds of other pressure, and a lot of (c)(3)s in the tech world have parallel for-profit corporations or (c)(4)s for this reason.

          Additionally, if you look at the LF's 990 Schedule C, you can see they have minimal (less than $2K) expenditure on lobbying.
