    It's now clear that the DMCA infringement claim against 's Star Control: Origins rests primarily on "look and feel" (not assets). Why should that make the industry nervous? And how might the DMCA be revised to prevent abuse of such an approach?

    Good thread here. From a crisis communications standpoint, one thing I would add is that it sometimes feels like you need to bat away every misconception. Sometimes that’s right, but often silence and a cool off period can also be tremendously helpful.

    I don't care if you think or CEO Brad Wardell () is the devil, the entire industry should be *petrified* that the following was the basis for a DMCA takedown of a live game. (The filers claim rights in SC2 that were "infringed" by Origins.)

    Too often, folks let an advocate’s personality impact their understanding of science, economics, politics, or even...legal claims. We’re all human so it’s inevitable, but my advice is to pretend the person you like is advocating each position. It might just clarify some things.

    A useful exercise: Take "Star Control" out of it. If the game Stardock released was just called Origins, would you view the listed qualities as "infringing"? How about Fortnite and PUBG? Assassin's Creed Odyssey and Witcher/Dragon Age/Diablo/Mafia 3? HotS and LoL?

    Your business is not just your in-bound contracts, but your out-bound ones as well. Is that EULA or vendor agreement too draconian? Too soft? Your contracts say something about your business just as surely as your marketing. Make sure they say what you want them to say.
