The Executive branch controls DOJ, and AG Barr could decide not to prosecute contempt referral House sends to DOJ. Civil litigation takes time (though would force Giuliani to find and pay lawyers). 2/

IMO, the House should force DOJ to show its hand. But it is time for Congress to also implement its own enforcement powers. https://fas.org/sgp/crs/misc/R45653.pdf … 3/pic.twitter.com/9aHLIbdLOA

The inherent contempt power is pragmatic, not punitive (though I’m sure Giuliani wouldn’t see it that way). https://fas.org/sgp/crs/misc/R45653.pdf … 4/pic.twitter.com/HH5WW3l5Hb

Congress must make clear to all in Trump’s coterie that they will not be permitted to flout investigation into wrongdoing. Giuliani would be an apt person of whom to make an example, as he was a particularly big defender of and believer in deterrent power of law enforcement. 5/
