It's legal to simply not report a crime, so long as you aren't affirmatively covering it up or otherwise involved in the crime.

legally, yes. There might be issues around federalism (could a federal law permit disclosure of state crimes etc.). Issue is then practical.

First, what would be disclosed aren't crimes, they are allegations. If crime cannot be proved to criminal standard, etc. still protected?

I think he's talking about talking to reporters, i.e. Cosby Rape case, where settlement involved a gag order.
