Even if you assume that Democrats could have enacted a national law protecting abortion rights in 2009, wouldn't Republicans have just repealed it in 2017?

The Republicans would have tossed out the filibuster in a flash in order to get rid of a national law protecting abortion. And the Dems only had a filibuster-proof majority for about 4 months in 2009-2010, so they would have had to move it along quickly then.

Would they have had the votes -- with Murkowski and Snow? Pretty thin margins. They didn't have the votes to overturn ACA so hard to see votes on this.

I don't think there's any analogy between abortion rights (and in particular a federal law dictating to states what they can do) and the ACA when it comes to what the GOP base cares about.
