Spot on. In Canada, women weren't legally recognized as "persons" until 1929. It's true that women's rights aren't, as Alito says, deeply rooted in history. But that's a problem of patriarchy, not a grounds to dismiss these rights.https://twitter.com/DayleOhlau/status/1521872105561739265 …

‘Alito, shocked—shocked—to discover so little in the law books of the eighteen-sixties guaranteeing a right to abortion, has missed the point: hardly anything in the law books of the 1860’s guaranteed women anything. Because, usually, they still weren’t persons.’ -Jill Lepore

Not to mention the incorporation of constitutional rights in general is less than a century old.

It's just a circular argument against all progress. No progress can happen if the only things that are valid are those with deep historical roots

Ironically the persons case is the foundation of Canadian constitutional law that says rights are not deeply rooted in history

Wikipedia:"The Persons Case was a landmark case in two respects. The case established that Canadian women were eligible to be appointed senators and also established that the Canadian constitution should be interpreted in a way that was more consistent with the needs of society."

At least women's right to vote is constitutional with the 19th amendment. Still, I don't think the amendment mentions women, just sex.

Also, he's wrong that there weren't any legal arguments made for the right to abortion before the 2nd half of XXth century.

If you look at the history of the land currently covered by the United States you will find the existence of the US is not deeply rooted in history.
