The Moderna patent is currently liberated (as noted in the article you cited). As also noted, this does not solve the problem -- there are other patents held by other entities (which entities are paid by Moderna). There are actual secrets (protected by the 4th amendment)

Also no need to imagine. Those trade secrets were already considered very valuable last year when the USA was, in fact, at war. The companies were allowed to keep them during a war.
