      Here's the thing: Neither Disney or Marvel is ENTITLED to the ownership of Spider-Man. Which is why, in order to own Spider-Man, Marvel had Ditko and Lee agree to relinquish their rights to Spider-Man as part of the terms of employment.

      Any recommendations for reading on the legal history of the ownership of comic characters? I always thought that the publishers assumed legal ownership of anything in their magazines. I know Image was founded because artists and writers were fed up with this relationship.

      That's pretty much how it went. The idea that it wasn't is the result of decades of comic creators who felt they got a raw deal after comics exploded in popularity.

      That's completely untrue -- a myth created by corporate bootlickers and asskissers. Artists fought for rights from the start -- Sean Howe's account in his history of marvel is a good place to start.

          I think there’s a misunderstanding. Rights and credit have always been issues for artists/writers. That’s why Steve Ditko left Marvel. But legally, they were under a work for hire contract. 1/

          2/ The contracts were usually pretty unfair ($130 for Superman and all) which is what the artists/writers usually base their cases on. Courts usually side with the company. Are you saying there wasn’t such an agreement with Spider-Man?

          3/ I ask because Jack Kirby’s estate tried the same thing ~7 years ago and they lost, because Kirby was work-for-hire. I would assume Ditko’s contract was the same.
