2. The rioters of January 6 are subject to criminal penalties. No such penalties apply to theorists like Eastman who provided the rational for the coup attempt. But surely civil society has the power to sanction and ostracize?

4. Something like The Federalist Society has power in part because media liberal legal types, universities & moderate Republicans treat it as legitimate institution, participate in its events, elevate its voice, etc. What if they just didn't?

Perhaps a certain federal judge, suddenly so publicly proud that his advice ran counter to Eastman’s memo (though he was very silent until the memo became public), could publicly state the Federalist Society is a menace to the rule of law.
