      No, I mean that recognizing race-neutral laws can have a disparate impact is not CRT (which is also not, at all, "mainstream liberal civil rights thinking").

      Given Michelle Alexander is considered very CRT and her whole thesis is that race neutral criminal justice systems create racist results, in what way is that NOT a version of CRT? People want to make CRT more esoteric than it is.

      The thesis of The New Jim Crow is not that mass incarceration is a race-neutral system that happens to produce racist results. Her thesis is that it is a system consciously designed, as part of the backlash to the CRM, as a racial caste system of social control.

      It’s based on not explicitly including race but targeting racial outcomes. You’re arguing the same thing except pretending that pointing out the obv racist impact and design somehow negates that they wrote it to pretend it was race neutral

      Wait, why are we pretending that normal civil rights analysis didn’t know about allegedly race neutral laws with disparate impact on race? Disparate impact discussions existed in the 1960s.

      @jholbo1 I want to flag this thread because only 2-3 weeks ago we were involved in a sprawling thread where Jeet was very narrowly policing tight definitions of CRT when attacked by its critics. But now he is boosting CRT by confusing it with bog standard 1970s disparate impact

      …analysis from the civil rights era. Positioning normal civil rights stuff as CRT when CRT is very clear that it is a break from civil rights analysis makes that whole discussion feel opportunistic rather than an attempt to be illuminating.

      Naw, he's making a perfectly fair joke. The war on CRT is, in effect, a deliberate attempt to make it be that, not only is there no CRT narrowly, there's no sort of critical theorizing about race. There is clearly overlap between CRT and bog standard disparate impact.
