If we were starting over from scratch, that might be true. But all reform starts from where we are and involves some parties losing power relative to the present, which is all it takes for the reform itself to have no legitimacy for many.

Then maybe the secret is appointing judges that recognize the primacy of the laws and constitution created by those democratic institutions rather than ones who subscribe to a "living constitution" that always grows in the direction of their policy preferences.
