Grounding major policy decisions in actual accountable democratic institutions is more likely to prevent a civil war than having them sorted out by courts with a life-time tenure.

I'm not so sure the court HAS much credibility these days. It's full of partisans who more often vote the way their 'side' wants them to vote. This will especially be true if Trump successfully appoints somebody super partisan to the court.
