Seriously, though: for most of the religious right the "but Judges..." argument boils down to abortion and LGBT rights. What becomes of that argument when courts don't deliver (but very much do deliver on stuff plutocrats want)?

Would require finding another issue to organize around though. A heavy lift for a lot of people who have staked their entire professional careers on opposition to abortion and gay rights.

I read an article, many many years ago, about how the GOP has no intention of letting abortion be criminalized, because if it is, what can they rally their followers around? Gay marriage? Enh, losing traction Guns? Not as universal. Abortion though, that'll keepem rabid.

Bingo. Abortion is the big moneymaker for both the GOP and the Evangelists. If it went away they would have to find another issue to grift on.
