I'd say, "No." They can point to limited suspension of habeas (which is implicitly allowed by the constitution) and censorship. But I think we need to evaluate by context in a non-tendentious fashion. Given the widespread rebellion and civil war, what jumps out most ...

Yes. Suspending habeas corpus "when in cases of rebellion" is in the Constitution; our founders forgot to mention which branch actually gets to suspend it lol. More on point, it's sure feels as if post-liberalism stuff, in it's cleaned-up versions, is meant to troll, as in here.

Yes. But I don't think Ross is meaning to draw on those arguments, or at least not seriously, or beyond provocation.
but as we know from, say, the bromance between american conservative types and gore vidal, the overlap is not entirely a coincidence (also, first things people are big schmitt fans, who of course owes all his contemporary reputation and preservation to left academics)
