I wouldn't prosecute this statement for perjury. He could have merely meant to be misleading and considered "after publication of the story" to include learning of the story before it went to press.

Depends--he could easily say he found out from the New Yorker because they contacted him about the story--thus, before publication. When did reporters ask him for comment? Do the texts pre-date that? Then he's lying.

He is quoted in the article as denying it so I don’t know why he testified that he hadn’t heard about it until it was published. Makes no sense.
