No it's not. If you're accused of doing something that isn't illegal, and you didn't do it - what are you going to say? That you didn't do it and that it's wouldn't be illegal if you had. Why are you people so obsessed with pretending what trump is doing isn't logical?

So for example lets say someone falsely accused you of being a criminal b/c you were walking around with a sword in Texas. You would probably say that: A) You weren't doing that and B) even if you had you wouldn't be a criminal, because it's legal to do that Same thing

yeah except in this case both statements are consistent. If someone accuse you of being a criminal because they falsely claim you did something that isn't illegal - what are you supposed to say? Obviously you would point out that you didn't do it and it that it's not a crime

In order for something to be a conspiracy, there has to be an underlying, specific crime that took place. You can't just charge people with "conspiracy" in some abstract sense.
