First degree murder is overreach. Second degree murder or voluntary manslaughter are more likely to get convictions. Virginia only executes people for first degree murder, I think.

They made it first degree murder in December. Regardless of the sentence, if there was no intent, there was no murder of ANY degree. And the fact that he was under attack even negates negligent homicide.

I know MD law and the UCMJ better than VA law — but you can get 2nd if you show callous disregard for the lives of others when acting out of rage, or acting with gross negligence & recklessness. Eg — Throwing a toilet out of a 3rd story window for the lolz could get you 2nd...

I understand, and all of that is CONTRADICTORY to the prosecution's core claim: that Fields was a "domestic terrorist" who planned this out.

Yeah. I don’t think he is a domestic terrorist. I don’t think they will convict him of 1st degree murder provided that he has a good lawyer.
