In the “Muslim Ban” case, Roberts opined in dicta that the Korematsu decision was unconstitutional. There was absolutely no reason to overrule Korematsu this way; and so brazenly, from a supposedly conservative justice.

I am excited about the politicization and partisan nature of the legal profession and courts. The more the public loses faith in the legal system, the better. It’s impossible for us to win with the rules we have now. Eventually court orders will be ignored and unenforceable.
