So, here's the Virginia law on Brandishing. Pointing a firearm in such a manner as to reasonably induce fear in another of being shot or injured (excluding self-defense). My guess is that he would reply that he waived him off before the pass where he crashed, arguing that he was circling while looking for an opportunity. The real question here is what other eyewitness reports and physical evidence say about the matter.

It's a huge admission. In general "waiving someone off" with a gun is going to be a felony.

They're protected. He isn't getting charged with anything, admission or no admission. If he was gonna get charged, he would have been already. The interesting thing is just how quiet the media is about the whole investigation. Nothing substantive at all. Silence speaks volumes.
