Ok... But Pearl Harbor wasn't a surprise at the highest levels of American government. American policy was designed to push the Japanese into attacking the Pacific Fleet.

That's not the definition of a surprise attack. A surprise attack is...a surprise. Which this was not. Besides, the Japanese didn't intend to attack before the Declaration was delivered. Even more, the US knew about the DoW before it was eventually given to them (spying).
