We have neither a rape culture nor an abortion culture. We have a culture in which rape is regarded as one of the worst crimes ever and reproductive freedom is a right. I like this culture. https://twitter.com/MitchumsGhost/status/983864799867080705 …

How do you suggest we ascertain beyond reasonable doubt that sex was non-consensual as easily as we can show that car theft was non-consensual?
-
I wish we could show this but I just don't see how when people have sex all the time but don't give people their cars all the time. It ends up as one person's word against another's. It's horrible that this is the case but it is the case & I don't see a way to change that.
-
You've actually just pointed out one of the biggest problems that isn't addressed by our justice system, most of the times it will be his word against her word, so beyond reasonable doubt is very hard to reach. But think further about what kind of society you create when rapists.
-
How should the justice system be addressing it?
-
Well ok, this is a long list: the first thing we need is a social change - in our society women's sexuality is over valued and men's is undervalued (which is why men getting raped by women is considered a joke). A social change would inlude educating young adults about consent...
-
You think they're not? That people rape because no-one has ever explained to them that they need consent?
-
Yes. Like my story before - none of the people with me realized they were talking about sexual assault. I've also heard reports from other women where the rapist tried to make them feel good, but ignored the signs that they did not want to have sex.

When men asked each other if they'd be able to stop when about to orgasm?

Sorry I said theft, when I was comparing to robbery - confusing specific crimes! And I see no discrepancy. Proving rape to BaRD standard is hard - physical evidence often consistent with consensual sex; relying on *one* witness (victim); he/she said; capacity for consent...
-
But this is my argument for why conviction rates and reports are low rather than 'because society doesn't care about rape.'
-
I think both are at play. Getting a conviction is hard, sure; but if, for example, police are more inclined to assume a claim is false than it is actually likely to be, that's going to be a significant deterrent to reporting even reasonably provable crimes.
-
Then show that they are. Wasn't there a story recently where police were pushing for convictions due to pressure?
-
No idea. Wouldn't be surprised - plenty of examples of police being over- or under-enthusiastic in investigating crimes in different places, at different times, by or against different groups... But, as I said, plenty of evidence lying unprocessed...https://www.usatoday.com/story/news/2015/07/16/untested-rape-kits-evidence-across-usa/29902199/ …
