I do think we need to have due process for jihadis. This is, after all, how we ensure that they are jihadis. Same principle as for rapists. Not if they are determined to be enemy combatants. If so, they do not have due process rights and would not be tried in our criminal courts.

But you'd have to show they are so determined. Obviously, if they're swinging a machete at you, you can shoot them. Same as if someone is trying to rape you. Otherwise, both merit due process.
