There needs to be a reasonable scale as with other behaviours. Someone punches you, press charges. Someone pushes past you, probably not.

Not exactly. He is asserting that 'x is not assault', when all legal definitions state otherwise. He's objectively wrong.

I didn't say he said the law doesn't allow for prosecution. He's using a legal term and saying something is not <legal term>, when it is.
