You don't get to dictate what does not 'qualify' as assault though. You can give your opinion, but you don't get to pretend your own facts.

The legal definition is objective. Its foundational criterion - consent - cannot be anything but subjective.

There needs to be some reasonableness. I do not like being touched, I find women much more likely to try to hug me. It's not an assault.

But I don't put that on other people. I ask them not to if it seems likely to be repeated. I make it clear I don't like it. Not an assault.
