Saying we’ve too many black people in the firm would be racist and entirely unacceptable. Which part of the memo is analogous to that?

The CEO didn't accuse him of being racist. He said he failed to abide by the Code of Conduct -- a sacking offence.

I didn’t see anything in his behaviour that breached the code of conduct and the CEO failed to mention which part of the memo did so.

Just questioning the efficacy of affirmative action is a clear breach of the code of conduct? It is a sackable offence merely to discuss it?

I don't think the guy was doing his utmost to create a workplace culture that is free of bias -- that's what the Code calls for.

But neither is anyone claiming that unequal representation is the result of discrimination. This is subject under debate.
