Which is why I tend to thing govt should stay out of legally defining relationships. Any line you draw is arbitrary.

Too simplistic. If incapacitated without a living will, spouse can make decisions for me because of how gov legally defined our relationship.

(how many have living wills? My toddler doesn't have one. I can make decisions for him because of how gov legally defines our relationsip!)

If I die without a will, heirs will not be destitute -- they'll be chosen precisely from how our relationships are (legally) defined.
