The reason is practical. People tend to put up more of a fight when the sensibilities offended are religious ones.

But they seem to be arguing ethically & bringing up constitution as tho constitution synonymous with ethics.

Hence the need to point out the difference. Pragmatism demands adapting to (or better—changing) laws to achieve ethical results.

This used to be the case with some piercings and trousers for girls at schools I attended. Banned unless religion was involved.
