Intuition (human nature?) favours/demands 'payment' but the law should (imo) be above that and not fuel hate.

I think human law will always serve human needs & retribution is a large part of our evolved psychology.

One of the reasons I am so against capital punishment. It prioritizes vengeance over justice.

Yes, we need to feel retribution is fair & measured.James' book mentions that study where ppl will pay to punish

I think I first came across it in Haidt. Ppl will disadvantage selves to punish others tho it won't benefit them

I think you're right. It's a part of human nature to want retribution. Shame this limits how civilized we can be.
