I think the intention & the impact of speech or action matter. Tendency to focus too much on impact now, I think.

But big difference to how we see driver & in cases not actually involving death, shld be significant difference to the impacted person.

My experience of being elbowed in the face by my husband was much less traumatic for knowing it was an accident! Devastating if deliberate!

This seems much clearer with actions but ppl are reluctant to see that they also have some part in how they perceive words aimed at them.

1k ppl drive drunk. 989 no consequences (+luck?), 10 caught & fined . 1 kills (-luck?) & imprisoned. All drove drunk. Fair?

Not really, no. Consequences do matter tho.

Agree but I think 'sentence' should be averaged and not luck-based for same action (where poss). I don't like revenge in law.
