Yeah I think that is definitely one way to go about it for a hypothetical society. But the US Constitution clearly has “freedom of religion” enshrined as a basic principle, so I think that requires some kind of effort to define “religious beliefs”.

It also has freedom of speech in the same amendment and that should cover all thought.
