Legally, Borgata cannot obtain a double recovery. Total damages capped at actual loss.

Two reasons. 1) Alternate theory of recovery if Ivey wins appeal. 2) Source of funds if Ivey loses appeal but can't pay full judgment.

There are differences in what damages can be recovered in contract (Ivey) and tort (Gemaco). Might not align perfectly.
