      They bet on horses. That’s a sport. I hear that argument a lot from horse racing folks. “We were the first at legal sports betting.” Kinda true.

      Of course, if there is no law in KY stating that sports betting is illegal, and PASPA is gone, why isn’t sports betting legal in KY? May not be regulated, but it may be legal. Could be that way in a lot of states.

      That certainly was the interpretation of DraftKings and FanDuel in MANY states for fantasy. Why not for sports betting?

      Sports betting is likely illegal under a general gambling law (i.e., any non-authorized gambling is illegal). DFS always argued it was not gambling at all to avoid these sorts of statutes. NOTE: I haven’t looked specifically at KY law. This is the usual state legal regime.

          Let’s just go to the source. @KYSenateDems what exactly did Senator Carroll mean when he stated that sports betting was already legal in KY? Couple of great legal minds, industry insiders, and a gambling lobbyist can’t figure what he meant. Enlighten us please.

          Non-lawyer here, but don't both conditions have to be met to reach the conclusion? "A contest or game in which eligibility to participate is determined by chance and the ultimate winner is determined by skill shall not be considered to be gambling."
