Presumably this is meant for things someone believes is illegal, rather than just something that offended somebody.

Yeah, there are certain criteria that a crime must fit to become a hate crime. If for instance someone is using obvious slurs while assaulting someone for their race or religion, etc. Others are harder to prove but it's an important distinction to make.
