Technically it's still OSINT. Morally it's deplorable. If they're peddling the term "OSINT" to justify their actions, then they're a twat.
I've yet to use the term OSINT and now I plan not to :D

It's a perfectly good term to use when it's being enacted legally (i.e. for a customer, with a contract etc).
