So the data could theoretically be included in the database without, say, the local public health ministry “sending” it to Surgisphere. But, Gid is saying that all Aussie hospitals are public, and doesn’t seem to believe this would be allowed. Is that right?

Like, in the US, if my hospital joined this 'collaborative' my local county/state health department could say "We aren't providing any data to Surgisphere" but they could still have my hospital's data.

Because I don't think the authors or Surgisphere are claiming that the public health authorities "sent" them data specifically for this study. Their system automatically integrates data from all of their participating hospitals.

But also, I feel like I haven't explained well. Individual Aussie hospitals are owned and operated by the states, so if the state health department says they don't use the database they mean none of the hospitals do either

Yes, that's the thing I'm trying to understand (from across the world and in a different healthcare system). In the US, a hospital could join such a "collaborative" and provide their data without the "state health department" having any say in the matter.

Also, I feel like the term "use the database" is important above - I don't think a hospital really "uses" the database, I think the way this works is that the Surgisphere database scrapes everything from the hospital EHR's (cont...)

...but maybe you're saying that it's not possible for the Surgisphere database to scrape an individual hospital's EHR in the Aussie system because that hospital's data would be entirely overseen / operated by state health dept. Am I getting that right?
