As per the 2012 MyHealthRecord act, it is a criminal offence to inappropriately gather data from a MyHealthRecord (including inappropriate access) punishable by some hefty criminal and civil penalties

Not sure two years jail is "hefty" ! And how often do max sentences get imposed? Almost never. Penalties after the act are too late if the info already all over the community, etc! Need a system that stops dissemination, not slaps wrists afterwards!

Well, firstly, that's fairly subjective. But it also comes with a $130,000 fine. And it's *per offense*. So a single access of a single piece of information, maybe just a slap on the wrist. A few bad accesses of many pieces of info could lead to decades of prison time
